Talking and paving seems like a bad idea during repairs

As a resident of east Bakersfield, I greatly appreciate the much needed repair work being done on Mount Vernon Avenue. I am even able to tolerate the disruption of traffic without too much grumbling.

But I am wondering if the construction workers are exempt from the laws that apply to California residents. On a recent morning, while waiting in yet another line of traffic, I observed the operator of the steam roller talking on his cell phone. Does state law not prohibit the use of cell phones while driving a moving vehicle?

Perhaps I should just be thankful that he was keeping his eyes on the pavement he was compacting and not sending a text message!
