Court filings say Jonathan Michael Hearn and Sabrina Limon exchanged thousands of text messages prior to the murder of Limon's husband, including one in which Hearn told Limon that with her husband out of the picture they could live their lives together.

The probable cause declaration filed by Kern County sheriff's detectives in the case against Hearn say he and Limon, his alleged lover, conspired to kill 38-year-old Robert Limon. Hearn, 24, has pleaded not guilty to first-degree murder and is being held without bail.

Prosecutors said Thursday charges had not been filed against 35-year-old Sabrina Limon due to insufficient evidence. Deputy District Attorney Esther Schlaerth did not close other details, but when there's insufficient evidence prosecutors typically give the case back to detectives for further investigation that could lead to the filing of charges.

The probable cause declaration says Sabrina Limon told Hearn where her husband was working and his schedule the day of the killing. Investigators said in the declaration that video surveillance captured Hearn fleeing the scene just minutes after Robert Limon was shot twice in the head.

The declaration says Hearn disposed of evidence that investigators have recovered.

An employee of Burlington Northern Santa Fe Railway, Robert Limon was found dead Aug. 17 in a BNSF industrial complex at 1528 Goodrick Drive in Tehachapi. He'd last been seen leaving fieldwork at 5 p.m.

Prosecutors allege Hearn was lying in wait to kill Robert Limon. Hearn's attorney, Clayton Campbell, has said just because his client's charged doesn't mean he's guilty.

Hearn is next scheduled to appear in court Dec. 5.
