Homebuilder seeks to have indictment dismissed

A couple accused of failing to finish work on homes they were paid to build has filed a motion to dismiss a grand jury indictment, as well as a request for a change of venue.

Donald and Denise Juhasz are accused of stealing more than $300,000 from 11 victims.

A hearing in Kern County Superior Court is set for Sept. 8 on felony charges of conspiracy, forgery, diversion of funds more than $1,000 and grand theft.

The defense contends prosecutors inappropriately failed to present the grand jury with information about two couples who had been repaid for their losses.

The change of venue was requested because the case has garnered a lot of publicity, according to the defense.

Assistant district attorney Richard Jackson said the District Attorney's office plans to answer the motions by next week.

The county grand jury returned indictments against former Bakersfield homebuilder Donald Juhasz and his wife, Denise Juhasz, in May.
