In the fall of 2006, the alleged victim was a 14-year-old Stockdale High School freshman when several students used plastic wrap and duct tape to bind him from his ankles to shoulders and put duct tape on his mouth, according to the lawsuit.
"What my client went through shouldn't be experienced by any child," said Ralph Wegis, the attorney for the alleged victim. "The safety of our kids at schools is the bottom line."
The suit was filed this past October and names the school district and teacher Richard Bookout, along with several students and their parents.
A counter lawsuit against the alleged victim was filed by one of the accused bullies, but his attorney could not be reached Monday night.
The plaintiff, who is only identified as John Doe, was staying at a hotel in Stockton with the other students, the lawsuit said. They were taking part in a forensics debate tournament.
Students also urinated on the alleged victim's clothes and showed pictures of the bound student to debating competitors, the lawsuit said. The student had also been bullied at the school, according to court documents.
The suit claims Bookout, the forensics teacher, did not supervise the students at the hotel and the school district allowed one of the accused bullies to remain in the same class as the alleged victim after he reported the incident.
