The Bakersfield Police Department Critical Incident Review Board has concluded that the shots fired by Officers Isaac Aleman and Seann Woessner on Jan. 1 were within department policy and state and federal guidelines.

Aleman and Woessner have been cleared to return to duty.

The officers had responded to the 700 block of Terrace Way after receiving reports of shots being fired, police have said. As the officers walked through the complex, they heard shots and saw a man holding a rifle.

Officers identified themselves and ordered the suspect to drop the rifle, police said. The suspect refused and ran.

The suspect, later identified as Abel Gurrola, 25, was shot during the chase and taken to a local hospital where he died the next day.

Family members of Gurrola have said he was firing the rifle to celebrate the New Year.

The Review Board was comprised of Assistant Chief Lyle Martin and Captains Joseph Bianco, Hajir Nuriddin, Scott McDonald and Brian Clayton. Police Chief Greg Williamson reviewed the investigation and concurred with the Review Board's findings.
