A new trial date has been set for a man accused of murdering a 2-year-old boy.

Joshuae Preston's second trial is set to begin May 20, according to Kern County Superior Court records. His first trial ended Wednesday in a hung jury, with 11 out of the 12 jurors voting not guilty.

The case is being prosecuted by Deputy District Attorney David Zulfa, and Preston is represented by Deputy Public Defender Paul Cadman.

Preston is charged with murder and assault on a child resulting in great bodily injury or death in connection with the death of Guillermo Alvarez.

Guillermo died in 2009 of blunt force trauma, according to the coroner's office. Deputies have said Preston was the only adult caring for Guillermo and four other children while his girlfriend, Gina Serna, was at work.
