At 1:25 p.m. Tuesday, Bakersfield police were dispatched to Dr. Martin Luther King Jr. Park at 901 E. California Ave. for a report of an assault with a deadly weapon.

Officers found Donald Ray Herron 46, suffering from multiple stab wounds. Herron was taken to a local hospital where he died a short time later.

Detectives learned that Herron was involved in a physical altercation with a 56-year-old man at the park. During the altercation, Herron was stabbed.

The other man was detained and gave a statement that several witnesses corroborated.

According to the witnesses, Herron instigated the fight and struck the victim several times with a wooden stake. At one point, Herron and the victim were separated by onlookers and witnesses heard the victim tell Herron he did not want to fight.

Herron continued striking the victim with his fists and the victim, believing he was about to lose consciousness, stabbed Herron with a knife.

The victim was released and transported to a local hospital for treatment of his injuries.
