A daughter pleaded no contest Thursday to embezzling money from her mother and was sentenced to time served and three years' probation.
Donna Michelle Martinez entered the plea to a misdemeanor count of theft or embezzlement by a caretaker exceeding $400, according to Kern County Superior Court records. Felony charges of obtaining money by fasle pretenses, grand theft property and embezzlement of private property of more than $950 were dismissed.
The case received added attention when the mother, Gloria Moody, alleged a Kern County sheriff's sergeant compromised the investigation when he began dating Martinez's daughter. Sgt. Vince Martinez, who is not related to the family, was investigated but no criminal charges were filed.
The allegations stemmed from an investigation Vince Martinez worked on from October 2009 to March 2010 regarding alleged embezzlement of property and $30,000 from Moody, according to documents filed in court. Martinez fell for Samantha Martinez, the daughter of Donna Martinez, and the two began a relationship.
Vince Martinez posted pictures of Samantha on his Facebook page and took her to a Sheriff's Department promotion ceremony, the documents say. He also sat with the Martinez family during a civil hearing between Moody and her daughter.
Moody said the criminal investigation into the embezzlement went nowhere after Martinez started dating her granddaughter. She said she eventually got her house and car back.
